General Terms and Conditions (GTC)

1. Subject of the GTC

1.1. These General Terms and Conditions (GTC) apply to all orders and reservations offered via the websites www.yoojis.com and www.nooba.ch and made directly via the website or in any other form (e.g. by telephone).

1.2. These GTC are an integral part of the contract between Two Spice AG, Industriestrasse 28, 8305 Dietlikon (Two Spice) as provider of the offering on www.yoojis.com and www.nooba.ch and the customer who places an order or reservation. By placing the order or reservation, the customer confirms that he/she has read, understood and accepted these GTC without reservation. If any deviations are noted on the order confirmation, these shall prevail over the GTC.

2. Order or reservation

2.1. Orders and reservations can be made via a user account but also without a user account.

2.2. If Two Spice has reasonable doubt as to the accuracy or authenticity of the request or contact information, the order or reservation may be refused at any time.

3. Offering

3.1. Details provided on the website regarding the ordering options (in particular prices, photos, description of the products, available stocks and delivery times) are for information purposes only. They do not constitute a binding offer and may be changed at any time. Only the order confirmation is authoritative.

3.2. When purchasing alcoholic beverages, the customer confirms that he or she is at least 18 years old. For beer and wine, the customer confirms that he or she is at least 16 years old. Customers who have ordered alcoholic beverages must be able to show identification upon request.

4. Prices and payment

4.1. All prices stated on the website are in Swiss francs (incl. VAT) and must also be paid in this currency. The prices listed in the cost overview prior to concluding the order shall be deemed binding.

4.2. Two Spice reserves the right to charge a delivery fee, which is subject to change. The customer will be informed of any such costs before the order is completed.

4.3. Two Spice may require a minimum order value or charge an additional fee if the minimum order value is not reached. The minimum order value is subject to change. The customer will be informed of any applicable minimum order value before the order is completed.

4.4. Any order placed by the customer requires prior payment of the full price by an accepted payment method before delivery.

4.5. The accepted payment methods are indicated during the order process. Two Spice may change the accepted payment methods at any time.

4.6. If payment cannot be charged to the payment method specified by the customer, the order will be cancelled without further notice.

5. Delivery

5.1. When the order has been completed, it will be confirmed by email.

5.2. Orders will only be delivered within Two Spice’s designated delivery area. Two Spice reserves the right to refuse orders, depending on the location of the delivery address. The delivery area can be changed by Two Spice at any time.

5.3. All deliveries are made to the address provided by the customer. If delivery details are incomplete (e.g. vague address, inaccurate information, etc.), if no one is present to receive the order, or if a delivery cannot be made for other reasons for which the customer is responsible, Two Spice is not obliged to redeliver and the customer is not entitled to a refund.

5.4. If the order is collected from the restaurant, the order is deemed delivered when it is handed over.

5.5. The delivery times indicated on the website are not binding but are listed for information purposes only.

6. Cancellation

6.1. Once orders have been confirmed, they cannot be cancelled, even if the stated delivery time deviates from the actual delivery time. Also, products already delivered cannot be returned or exchanged.

7. Reservations

7.1. When a reservation has been made, no claim to a table can be asserted as long as the reservation has not been confirmed.

7.2. The customer is not entitled to a particular table; tables are allocated by Two Spice.

7.3. Two Spice may restrict the time period during which a table is available.

8. Liability

8.1. Two Spice’s liability is limited to the extent permitted by law to acts or omissions committed with gross negligence or wilful misconduct.

9. Data protection

9.1. Information on data processing and data protection can be found in Two Spice’s privacy policy.

10. Final provisions

10.1. Two Spice reserves the right to make changes to these GTC at any time and at its sole discretion. The most current version of the GTC at the time of the order or reservation applies. Any changes to these GTC will be published online at www.yoojis.com and www.nooba.com . A change is deemed accepted by the customer and effective the next time the customer places an order or makes a reservation.

10.2. Should one or more provisions of these GTC be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that corresponds as closely as possible to the economic purpose pursued by the invalid provision.

10.3. These GTC are governed by Swiss law. The sole place of jurisdiction is Zurich, Switzerland.
